Terms of Service

By creating an account, subscribing to a plan, or otherwise using our services, you confirm that you are at least 18 years of age, have the legal authority to enter into this agreement, and agree to comply with these Terms in full.

If you are using our services on behalf of a business or organisation, you represent that you have the authority to bind that entity to these Terms.

Incep Digital provides the following services:

• Website Subscription — a fully managed website service delivered under a recurring monthly subscription. This includes website design, development, hosting, maintenance, and updates.
• Custom Website Design & Development — bespoke website design and development projects quoted and scoped individually.
• Social Media Advertising — paid ad campaign management on platforms including Meta (Facebook & Instagram) and TikTok.
• Web Analytics — setup and management of analytics tools including Google Analytics and Google Tag Manager.

We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice to affected subscribers.

To access our platform, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to notify us immediately at contact@incepdigital.com if you become aware of any unauthorised use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for an extended period.

Subscription plans

Our website subscription service is offered on a recurring monthly basis. Details of each plan — including features and pricing — are published on our Subscription Plans page. Prices are subject to change with at least 30 days' prior notice to active subscribers.

Domain fee

A domain name registration fee is not included in the monthly subscription. Domain fees are a separate, one-time (typically annual) cost of approximately $8–$15 USD, payable to the domain registrar.

Billing & payment methods

Subscription fees are billed monthly in advance. We accept Mobile Money, debit cards, and bank transfers, processed securely through Paystack.

Failed payments

If a payment fails, we will notify you by email and attempt to retry the charge. Continued non-payment may result in suspension or deactivation of your website until the outstanding balance is settled.

To enable us to deliver your website or services, you agree to:

• Provide accurate, complete, and up-to-date information when requested (e.g. business name, services offered, brand assets).
• Respond to our requests for content, feedback, or approvals within a reasonable timeframe. Delays caused by late responses may extend delivery timelines.
• Ensure that any content, images, or materials you provide are owned by you or that you have the right to use them, and that they do not infringe any third-party intellectual property rights.
• Not use our services for any unlawful, harmful, or deceptive purpose.

Your content

You retain ownership of all content, logos, trademarks, and brand assets you provide to us. By submitting content, you grant Incep Digital a non-exclusive, royalty-free licence to use it solely for the purpose of building and operating your website.

Our work product

Under the Website Subscription service, you have a licence to use the website for the duration of your active subscription. The underlying design, code, and templates remain the property of Incep Digital. If you wish to migrate your website to another provider upon cancellation, we will discuss handover options with you.

For custom design and development projects, ownership terms will be agreed upon in writing as part of the individual project scope.

Portfolio use

We reserve the right to display your completed website in our portfolio and marketing materials unless you expressly request otherwise in writing.

Cancellation by you

You may cancel your subscription at any time from your account dashboard. Your subscription will remain active until the end of the current billing period, at which point it will not renew and your website will be deactivated.

Refunds

Monthly subscription fees are non-refundable once a billing period has begun, except where required by applicable law or where we have failed to deliver the agreed service. If you believe you are entitled to a refund, please contact us at contact@incepdigital.com.

Cancellation by us

We reserve the right to cancel or suspend your subscription for non-payment, violation of these Terms, or illegal activity. In cases of termination due to our fault, we will provide a pro-rated refund for the unused portion of the current billing period.

To the maximum extent permitted by applicable law, Incep Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost revenue, loss of data, or business interruption — arising from your use of, or inability to use, our services.

Our total aggregate liability to you for any claims arising under these Terms shall not exceed the total fees you paid to Incep Digital in the 3 months immediately preceding the claim.

Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that our services will be uninterrupted, error-free, or free of viruses or other harmful components. We are not responsible for any downtime caused by third-party hosting providers, payment processors, or other infrastructure outside our direct control.

Results from social media advertising and web analytics services may vary. We do not guarantee specific outcomes such as increased sales, website traffic, or return on ad spend.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ghana.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

We may revise these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will notify active subscribers by email at least 14 days before the new Terms take effect.

Continued use of our services after the effective date of any changes constitutes your acceptance of the updated Terms.
